Closing Out a Successful Week—Dismissals and Downpours

This week in Houston brought heavy rain—and two major victories in the courtroom.
At the David Smith Law Firm, PLLC, we’re proud to report that two DWI cases were dismissed, each involving clients facing serious allegations. One client was accused of driving with a blood alcohol concentration (BAC) of .173, and the other with a BAC of .140. These numbers might seem damning at first glance, but as with many criminal cases, the details matter—and in both instances, the details made all the difference.
Looking Beyond the Numbers
In each case, we identified significant issues with the evidence and the procedures used during the investigation. We took the time to thoroughly investigate, analyze, and present these issues to the prosecutors. And to their credit, they listened. After reviewing the facts and understanding the weaknesses in the cases, the prosecutors made the right call: both cases were dismissed.

Why This Matters
Dismissals like these are more than just wins—they’re reminders that every case deserves a second look. In the Greater Houston Area, where DWI charges can carry life-altering consequences, it’s critical to have an advocate who knows how to challenge the evidence, spot procedural flaws, and fight for fairness.
These outcomes also underscore the importance of acting quickly. The sooner a defense attorney can begin investigating a case, the better the chances of uncovering the kinds of issues that can lead to a dismissal.

If you or someone you know is facing a DWI charge in Harris County or the surrounding areas, don’t assume the case is open and shut—no matter what the BAC report says. There may be more to the story, and with the right legal strategy, there may be a path to dismissal!
